Cancellation & Refund Policy

 

Prices, Payments, Tax and Refunds

Prices as disclosed are subject to change at any time. Amount stated are exclusive of VAT, GST, Sales tax and/or similar.

Even for a free trial, we may require you to provide a valid credit card or other payment method. You will automatically be charged on the first day after the free trial period is over, unless a cancel request is generated, or you downgrade to a free Service before the end of the free trial period.

If you pay using a credit card or any digital payment method, you authorise XEditPro to charge your account for the Services using the same payment method on a recurring basis, unless otherwise specified. If your payment details turn invalid or if you notify us to stop using a previously assigned payment method and fail to assign an alternative payment method, we may immediately suspend use and access to the Services at the end of your paid subscription period.

You may upgrade your subscription, at that time, we will charge you the additional cost for that upgrade in respect of the remainder of your originally subscribed period and update your new payment period according to the upgraded subscription.

It is your responsibility to pay Taxes, if any is to be paid in your state/country, in addition to our price. If we are required to collect or pay Taxes, the Taxes will be charged to you. This includes adding GST at the payment checkout at the appropriate rate based on information you provide to us. Please note that we have no control over these charges and cannot predict their amount.

If you are not happy with our Service, we will offer a full refund if you give us written notice that you wish to cancel within 15 days of payment. If you are entitled to a refund, we will notify you about your refund via email within a reasonable period of time and process a refund within 15 days of confirmation of refund claim by us. Refunds will be made by crediting the same payment card or electronic payment account you used to subscribe. For the actual refund to reflect in you chosen payment medium’s statement, it may take a few more days depending on local regulations and your payment medium’s policy.

Cancellation

You may cancel your Paid Services by visiting your “Account” page and selecting “Subscription” or by contacting us at support@xeditpro.com. The cancellation of the Paid Services will go into effect at the end of your current billing cycle. When your Paid services end, your account will remain and become a free membership. You can renew your Paid Services at any time without opening a new account, although the Paid Services fees may have increased.

Unless otherwise agreed, we reserve the right to suspend or end the Services at any time, with or without cause, and with or without notice. If we suspend or terminate your use without cause, we will try to let you know in advance and help you retrieve data unless there is a legal court order.

After Cancellation

If your subscription for a paid account expires [including where payment has been made by someone else (e.g. an institution or other organization that you belong to) and that payment ends], we shall make efforts to ensure your content continues to be accessible via a “free” account, subject to compliance with the respective terms and conditions. If you have exceeded the limits of the free account, you will need to archive old content before being able to add more content.

You may close your account via your Account Settings if you would like to terminate the account in total. We may retain your content, as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your content as soon as possible from our servers, and backed-up versions might persist. We do not delete files from our servers that you have in common with other users.

No Warranties

THE SERVICES, INCLUDING THE MOBILE SERVICES, AND ANY THIRD-PARTY SOFTWARE, SERVICES, OR APPLICATIONS MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THIS SITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. XEDITPRO DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. XEDITPRO OR ITS PRINCIPALS, AFFILIATES, PARTNERS WILL NOT BE HELD RESPONSBILE FOR LOSS OR DATA CORRUPTION OR ANY OTHER HARM TO YOUR NETWORK OR COMPUTER.

XEDITPRO AND ITS PRINCIPALS AND PARTNERS DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT XEDITPRO OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF ANY PERSONAL INFORMATION OR LOCATION INFORMATION OR THE SERVICES IN TERMS OF SECURITY, SAFETY, CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL XEDITPRO, ITS PRINCIPALS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR (i) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, REGARDLESS OF LEGAL THEORY, WHETHER OR NOT XEDITPRO HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; (ii) ANY LOSS OF PROFITS, BUSINESS OR EARNINGS, EROSION OF GOODWILL AND/OR SIMILAR LOSSES, OR LOSS OR CORRUPTION OF DATA; OR (iii) IN RESPECT OF ANY CLAIMS RELATING TO THE SERVICES.

Notwithstanding any other provision in these Terms, nothing will affect or limit your statutory rights; or will exclude or limit our liability to the extent not permitted by applicable laws or regulations.

You agree to fully indemnify, defend and hold XEditPRO, and its affiliates, Principals, officers, employees, agents, suppliers and licensors, harmless on demand, from and against all claims, including losses (including loss of profit, revenue, goodwill or reputation), costs and expenses, including reasonable administrative and legal costs, arising out of any breach of these Terms by you.
